Terms of Service for DragonAI

Welcome to DragonAI ("the App"), powered by DragonAI LC. By downloading, accessing, or using the App, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the App.
1. Acceptance of Terms
By creating an account, downloading, or using the App, you acknowledge that you have read, understood, and agreed to these Terms and any future modifications.
2. Eligibility
The App is intended for users who are at least 13 years old. If you are under 18, you represent that you have obtained the consent of your parent or guardian to use the App. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

The App provides AI-powered services, including but not limited to [AI chatbot, AI image generations, AI video generator etc..]. Your use of the App must comply with all applicable laws, rules, and regulations. You agree not to misuse the App in any way, including, but not limited to:
- Violating any laws or regulations
- Infringing on any intellectual property or other rights of third parties
- Attempting to hack or disrupt the App or its services
- Uploading or distributing malicious software, viruses, or harmful content
- Harassing, threatening, or impersonating others
- Refrain from using and generating images or videos that are not safe for work (NSFW), which include explicit or adult content.
4. Account Registration
To access certain features, you may be required to create an account. You agree to provide accurate and complete information when registering and to keep your account credentials secure. You are responsible for any activity that occurs under your account.
5. User-Generated Content
By submitting or uploading content through the App, including text, images, or other materials ("User Content"), you grant DragonAI LC a non-exclusive, worldwide, royalty-free, irrevocable license to use, modify, distribute, and display your User Content within the App. You retain ownership of all intellectual property rights in your User Content.
You agree that you will not upload content that:
- Is unlawful, harmful, threatening, defamatory, obscene, or infringing on the rights of others
- Contains viruses or harmful code
- Violates any applicable law or regulation
6. Privacy Policy
Your privacy is important to us. Our collection and use of your personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the App, you consent to the collection and use of your personal information as outlined in the Privacy Policy.
7. Payment and Subscription Services
The App may offer premium features or services through subscriptions or one-time purchases. By making a purchase, you agree to pay the applicable fees and taxes. All payments are non-refundable unless otherwise stated in the App Store's refund policy. We reserve the right to change our fees or subscription terms at any time with prior notice.

9. Intellectual Property

10. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the fullest extent permitted by law, DragonAI LC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or these Terms. In no event will DragonAI LC’s total liability to you exceed the amount you paid to use the App, if any.
12. Indemnification
You agree to indemnify, defend, and hold harmless DragonAI LC, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including legal fees, arising from your use of the App or violation of these Terms.
13. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your rights to use the App will cease immediately.
14. Modifications to the Terms
We may modify these Terms at any time. If we make changes, we will notify you by updating the “Effective Date” at the top of these Terms or by providing a notification within the App. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of United Sates of America, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts located in United States of America.
